1. OUR SERVICES.

The Services are owned and operated by Harry’s Fine Food Store (“Harry’s”), a company registered in Zimbabwe (Reg No. 1895/2019), which has its registered office at Gate 3, Borrowdale Racecourse, Harare, Zimbabwe. All rights and/or defences afforded to us in these General Terms shall stand to the benefit of our company.

2. INTELLECTUAL PROPERTY RIGHTS.

All rights, including copyright, trademark and other intellectual property rights embodied in any logos, text, images, video, audio or other material on our websites, mobile sites are owned by or licensed to us. Unauthorised use, reproduction, modification and/or distribution of the content thereof is strictly prohibited and constitutes an unlawful infringement of our intellectual property rights.

3. USER REGISTRATION.

You may be required to register to use the Services, you must be 18 or older to register for use of our Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable. (We cannot be held accountable for any losses that you may incur due to loss of your password or account information) (We cannot assist you in any regard to lost passwords or forgotten account information)

These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers, or distributors.

Without limiting any other provision of these legal terms, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the services (including blocking certain IP addresses), to any person or persons for any reason or for no reason, including without limitation for breach of any representation, warranty, or covenant contained in these legal terms or of any applicable law or regulation. We may terminate your use or participation in the Services or delete your account and any content or information that you posted at any time, without warning, in our sole discretion.

If (after investigation) we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party.

10. GOVERNING LAW.

 These Legal Terms shall be governed by and defined following the laws of Zimbabwe. Harry’s Fine Food Store (Service Provider) and yourself (The Client) irrevocably consent that the courts of Zimbabwe shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Legal Terms.

11. AMENDED OR UPDATED TERMS.

We may periodically update or change the General Terms, without prior notice. We advise that you check them from time to time for any amendments or updates as continued use of our Services will mean you accept any updated or revised General Terms.

12. LAW AND ARBITRATION.

These General Terms are governed by the laws of Zimbabwe. Any dispute arising in relation to these General Terms shall, to the extent permitted by law, be referred to arbitration in Harare at a venue of our choice applying the Uniform Rules of the High Court of Zimbabwe.

13. CORRECTIONS.

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.

14. DISCLAIMER AND EXCLUSIONS OF LIABILITY.

Use of our Services is entirely at your own risk. We make no representations or warranties of any kind, whether expressed or implied. We do not warrant that the functions provided by the Services will be uninterrupted or error-free, or that the Services or the servers that make them available are free from viruses or other harmful components. We accept no liability, to the extent permitted by law, for any direct, indirect, incidental, special or consequential loss or damage of any kind whatsoever or howsoever caused arising from the access or use of our Services or the purchase of any of our products or services. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. You hereby waive any and all defences you may have based on the electronic form of these Legal Terms and the lack of signing by the parties hereto to execute these Legal Terms.
